The Openness of Local Government Bodies Regulations 2014

The Openness of Local Government Bodies Regulations 2014 (the 2014 Regulations) are designed to make local authorities more transparent to their local communities.  Regulation 7 of the 2014 Regulations requires that certain types of officer decisions are recorded and made available to the public.

What will be published?

We will publish a record of:
1.    A specific express delegation to an officer from the Council or a committee; or
2.    A decision made by an officer under delegated authority and the effect of the decision is to:
(a)    grant a permission of licence; or
(b)    affect the rights of an individual; or
(c)    award a contract or incur expenditure which will materially affect the Council's financial position.

What we record

The record will comprise:
1.    The decision taken and the date it was taken;
2.    Reason(s) for the decision;
3.    If any alternative options were considered and rejected;
4.    A list of background documents; and
5.    Where a decision has been taken under a specific delegated authority under 1. above, any conflict of interest a councillor has declared.

Please note that you will not be able to see information considered to be either confidential or exempt.

How to request information

A record of officer decisions will be published on our website . Requests for an electronic or paper copy of the written decision and background documents will need to be made to the Council in writing, either by letter or email to the officer who made the decision.  Alternatively, you may arrange to inspect the record, during office hours, at our offices, at the Civic Centre, Station Road, Addlestone, Surrey KT15 2AH.  Please telephone 01932 838383 to make an appointment.

You can ask for a copy of any documents (providing they are not categorised as confidential or exempt) relating to the decision and we will supply the information once you have paid for the postage, copying or any other necessary reasonable charges for transmission, which will be determined by us in accordance with our Schedule of Charges.

Exemptions

We will not publish purely administrative or operational decisions concerning our day to day workings.  Where we already publish information on our website e.g. planning applications or licensing decisions, we not republish the information.

The Council is currently in the process of making arrangements for the publication of decisions subject to the provisions of the 2014 Regulations.
