Under the Planning and Compulsory Purchase Act 2004, unless expressly replaced by a ‘new’ policy, ‘old’ policies (adopted local plan, unitary development plan and structure plan policies) are saved for 3 years from whichever is the later of:

• the date of commencement of Section 38 of the Planning & Compulsory Purchase Act 2004 on 28 September 2004 or

• the date the plan was adopted or approved.

The Secretary of State may make a direction to save specified policies beyond the 3 year period.

The government has now adopted a protocol that enables policies to be saved beyond the original 3 year period that expired on 27th September 2007. On the 21st September 2007 the Secretary of State agreed that the policies in the Runnymede Borough Local Plan 2001, and the Surrey Structure Plan 2004, be saved until such a time as they are replaced by policy guidance in the Local Development Framework.
