IMPORTANT INFORMATION FOR ALL BUSINESSES
Runnymede Borough Council's Environmental Protection Division recently reviewed and updated its Enforcement Policy document. The 2010 policy document contains two important points that will be of relevance to all business operating within or having an interest in a business operating within the Runnymede boundary.
Fixed Penalty Notices
Firstly, the policy now includes within the general enforcement options available to the Council the option to issue fixed penalty notices for a range of offences where the applicable legislation allows for their use.
Fixed penalty notices are presently issued by Runnymede in relation to offences under the smokefree legislation and the extension of their use to some environmental protection matters such as fly-tipping and duty of care offences allows the offender to discharge their liability for such offences without the Council having to instigate prosecution procedures in all cases. Publicity - Enforcement Actions
Secondly, the policy allows for the publication of cases of any businesses, licensees or individuals it successfully prosecutes for environmental health offences as well as those it rewards for implementing very high standards. Names of companies and individuals convicted of environmental health offences will be published on the Council's website. Paragraph 8.1 & 8.2 of the policy.
The policy deals with cases subject to appeal and the period of time information will remain on the Council's website. Additionally the policy allows for the publicising of all environmental health related notices issued by the Council which will appear on the website for a period of up to 3 years. (Notices subject to appeal or withdrawal will be removed as per the time limits specified in the policy).

The intention is to introduce the fixed penalty notice provision gradually to supplement the existing matrix of enforcement actions available to the Council whilst allowing time for businesses and individuals to comply with their duties and responsibilities under the applicable legislation. Publication of enforcement actions i.e. prosecutions and enforcement notices will commence as of the 1st September 2010. Only actions initiated after that date will be published no retrospective data will be included.
